Essentially, If I do a painting of a figure and it involves a logo that's okay as long as the intent isn't to paint primarily a logo and sell that. If that were the case, I could paint a logo on something, call it art and sell it.

But note the reply is NOT from a patent attorney (and anyway, you'd want an attorney who specializes in trademarks, not patents). Everyone is a patent attorney on the internet.

I'm not one - I'm not pretending to know for certain if it is or isn't.

I'm just saying due to the amount of money potentially involved I'd get a good solid legal opinion (from a REAL attorney) before selling anything.
