Unfortunately, it depends...
To the supposed letter of the law, they shouldn't be considered 'mint', but I have seen graded copies that are scratched but register as 'Mint' 9s or 8.5s (no, not mis-graded OPC). So it depends largely on who is looking at it.
I think a lot of collectors might not mind them, but it will largely depend on individual preference.
