That's probably the only way anything would change. I think the seller seems like a jerk, but It doesn't seem like he's doing anything wrong, at least as far as eBay would see it.

I'd think you'd have to send him a message asking if the pack was factory sealed (probably with the connotation that you wouldn't buy a non factory-sealed pack). Assuming he'd say that it was factory sealed, if you bought the pack, and didn't receive the gold refractor, file an item not as described with PayPal. With the email saying that the pack was factory sealed, there's no way he'd be able to prove what was in there without contradicting himself. That might give you a basis to contact eBay, after getting your money back.

That sums it up right there! The seller is making well over double his money on anything he's selling and getting positive feedback from the buyers. It's terrible, but buyer beware.

The fact you sold him a 31/50 and the pack had a 31/50 is not enough proof. There is enough evidence that Topps has had problems with the numbered cards that you could argue that there could be two 31/50.

I beleive that he did reseal the pack, but Topps previous errors does not help

Ironically, in the last post about him, I asked when he would start selling the gold ref hot packs, since he had won 5-6 of them in the past month.

I say send emails to Ebay AND the scammer. I love how he says "All of our hot packs are carefully selected to ensure that they contain the proper game-used or autograph cards as promised within our auctions."

Scans of "both" cards with a grid overlay highlighting the signatures would belay any argument that they are dissimilar...

Yes it is. Midwest bought the exact same card from the OP. The chances of him buying the card #'d 31/50 from the seller and then his hot pack containing the exact same card (especially when there has been no proof in 08 BC that this is a problem) are nearly impossible. It is plenty for evidence.
