Actually, to play Devil's advocate. A lot of times you do not actually pay 'til you show at the store to pick up the item. If you never show they just stick it in inventory and it was of no cost to them because they stuck it on an inbound truck anyways.

just an update its been 13 days since i paid and havent recieved my items.. I emailed him a couple night ago and no Reply.. im about to file my claims with Ebay do i need to do that for just 1 of the 3 auctions or do i need to open all 3 claims seperately

You need to open a claim for each item.
