STANDARD ADVERTISING POLICIES

  1. The forwarding of an order is construed as an acceptance of all the rates and conditions under which the advertising is currently being sold.
  2. An ad is not considered accepted until a final copy is reviewed by a Beckett representative to ensure it meets all standards and guidelines
  3. No conditions, printed or otherwise, appearing on the contract order or copy instructions which conflict with publisher’s policies will be binding on the publisher.
  4. Written reservation orders must be received by the space deadlines
  5. By submitting an advertisement for inclusion in a Beckett publication, the advertiser represents and warrants that it has the legal right and authority to advertise all goods (including without limitation all cards) and services included in such advertisement. In consideration of such publication, advertiser assumes all liability for its content and agrees to indemnify and hold Beckett harmless from any and all claims, losses, costs and expenses, including reasonable attorney’s fees, resulting from or arising out of publication of any advertisement submitted by advertiser.
  6. The publisher assumes no liability if for any reason advertisement is omitted from a publication.
  7. The advertising department must receive all advertising materials by the due date. Neither advertiser nor its agency may cancel or change orders for advertising after the space reservation deadline.
  8. First-time advertisers must send payment with advertising order until credit is established.
  9. All advertising orders are accepted subject to the terms and provisions of the current rate card. Orders are accepted subject to change in rates upon notice from the publisher. However, contracts may be cancelled at the time the change in rates becomes effective without incurring a short rate adjustment, provided the contract rate has been earned up to the date of cancellation.
  10. Publisher reserves the right to hold advertiser and/or its agency jointly and severally liable for such monies as are due and payable to the publisher.
  11. Orders for cover pages are noncancelable. Other color pages are noncancelable 10 days prior to rate card closing date. Black and white cancellations are not accepted after rate card closing date.
  12. Orders which contain incorrect rates, except for negotiated rates, or conditions will be inserted and charged for at the regular schedule of rates, and such errors will be regarded as clerical.
  13. All verbal instructions regarding contracts or insertion orders must be confirmed in writing.
  14. The Publisher’s liability for any error will not exceed the cost of the actual space occupied by the error.
  15. Positioning of ad is at the discretion of the publisher.
  16. Publisher’s liability for failure to publish ordered advertising shall be limited to publication of the ordered advertisement in the next available regular issue.
  17. The Publisher will not be bound by any conditions, printed, or otherwise, appearing in contract, insertion orders or copy instructions when such conditions conflict with rates, conditions and other terms set forth in this rate card.
  18. Rate base figures are publisher’s estimates of the average circulation for the period of time covered by the rate card and are not guarantees for individual issues.
  19. Beckett Publications cannot assume any responsibility for the validity of the products and services offered by advertiser.
  20. Beckett Publications reserves the right to reject or cancel advertising for any reason.
  21. Terms are Net 30 from date of invoice.
